Welcome to Perfect Paw™.

These Terms of Service ("Terms") apply to your use of the Perfect Paw™ website and online store, including browsing our website, placing orders and using any services we provide.

By using our website or placing an order, you agree to these Terms. If you do not agree with them, please do not use our website or services.

These Terms are governed by the laws of the Republic of South Africa.

1. Using Our Website

You agree to use the Perfect Paw™ website only for lawful purposes.

2. Products

We make reasonable efforts to ensure that product descriptions, photographs, prices and other information on our website are accurate.

However, colours and product appearance may vary slightly depending on your device, screen settings and lighting.

Product availability, descriptions and specifications may change from time to time.

Where a product is discontinued or becomes unavailable, we will deal with affected orders in accordance with applicable South African law.

Nothing in these Terms limits your statutory rights relating to product quality, safety or defects.

3. Orders

When you place an order, you are making an offer to purchase the selected products.

An order will only be considered accepted once Perfect Paw™ has confirmed the order and payment has been successfully processed.

We reserve the right to cancel or decline an order where reasonably necessary, including where:

  • A product is unavailable;

  • There is an obvious pricing or product-description error;

  • We suspect fraudulent or unauthorised activity;

  • Payment cannot be successfully processed; or

  • Circumstances outside our reasonable control prevent fulfilment.

If we cancel an order after payment has been received, any refund due to you will be processed in accordance with applicable law.

Please review your order carefully before completing your purchase.

4. Prices and Payments

All prices displayed on our website are shown in South African Rand (ZAR) unless stated otherwise.

We may change prices, promotions or discounts from time to time. The price applicable to your purchase will be the price displayed at the time you place your order, subject to any obvious error.

You are responsible for providing accurate billing, delivery and contact information.

You confirm that you are authorised to use the payment method provided for your purchase.

5. Shipping and Delivery

We aim to dispatch and deliver orders within the estimated timeframes stated on our website.

Delivery times are estimates and may be affected by courier delays, incorrect delivery information, public holidays, severe weather, strikes, service interruptions or other circumstances outside our reasonable control.

We will take reasonable steps to assist where a delivery is delayed or lost.

If you provide an incorrect or incomplete delivery address, additional delivery costs may apply where permitted by law.

Nothing in this section limits any rights you may have under South African consumer law.

6. Returns, Refunds and Defective Products

Our Returns & Refund Policy forms part of these Terms.

Perfect Paw™ offers a 14-day voluntary return period for eligible change-of-mind returns, subject to the conditions set out in our Returns & Refund Policy.

Consumers also retain all applicable statutory rights under South African law.

Where goods are defective, unsafe, incorrectly supplied or otherwise do not meet the requirements of the Consumer Protection Act 68 of 2008, the applicable statutory remedies will apply.

For qualifying electronic transactions, consumers may also have rights under the Electronic Communications and Transactions Act 25 of 2002, including applicable cooling-off rights.

7. Pet Products and Responsible Use

Perfect Paw™ sells products intended for pets and their owners.

Customers are responsible for selecting products appropriate for their pet and for following any instructions, warnings, size recommendations or safety information supplied with the product.

Pets should be supervised when using products where appropriate.

Pet behaviour varies from animal to animal. Perfect Paw™ does not guarantee that a particular pet will use, enjoy or respond to a particular product in a particular way.

Normal wear and tear or damage caused by chewing, scratching, biting, misuse, neglect or improper use is not necessarily a product defect.

This does not affect any statutory rights relating to defective or unsafe goods.

8. Intellectual Property

All content on the Perfect Paw™ website, including our:

  • Name and logo;

  • Branding;

  • Product names;

  • Text;

  • Graphics;

  • Photographs;

  • Designs;

  • Videos;

  • Website layout; and

  • Other original content

belongs to Perfect Paw™ or is used with permission from the relevant rights holder.

You may not reproduce, copy, modify, distribute, sell or commercially use our content without our prior written permission.

All rights not expressly granted to you are reserved.

9. Customer Reviews and Feedback

If you voluntarily submit a review, photograph, comment, testimonial or other feedback to Perfect Paw™, you confirm that you have the right to provide it.

By submitting content to us, you grant Perfect Paw™ permission to use, reproduce and display that content for legitimate business, marketing and promotional purposes, subject to applicable law.

We may remove content that is unlawful, misleading, abusive, defamatory, offensive or infringes another person's rights.

We do not guarantee that customer reviews or feedback will be published.

We may also provide links to third-party websites.

We are not responsible for the content, availability or practices of third-party websites or services that are outside our control.

11. Shopify

Perfect Paw™ uses Shopify to operate and provide our online store.

Your purchase is made directly with Perfect Paw™ and not with Shopify.

Shopify provides the technology that enables us to operate the online store, but Shopify is not responsible for the products we sell, our customer service, or the fulfilment of your order.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy and applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).

By using our website, you acknowledge that your personal information may need to be processed by Perfect Paw™ and relevant service providers to process orders, payments, deliveries, customer enquiries and other legitimate business activities.

We make reasonable efforts to keep the information on our website accurate.

However, occasional typographical errors, pricing errors, technical errors or inaccuracies may occur.

To the extent permitted by South African law, Perfect Paw™ will not be liable for losses arising solely from circumstances outside our reasonable control, including certain third-party service interruptions, courier delays, technical failures or events beyond our reasonable control.

Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited under South African law.

In particular, nothing in these Terms limits your rights under the Consumer Protection Act or other applicable legislation.

We may update these Terms from time to time to reflect changes to our business, website, services or applicable legal requirements.

The latest version will always be made available on our website.

Where required by law, we will provide appropriate notice of material changes.

Your continued use of our website after updated Terms have been published constitutes acceptance of the updated Terms to the extent permitted by law.

These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.

Nothing in these Terms prevents a consumer from exercising any right or remedy available under applicable South African consumer protection legislation.

The remaining provisions will continue to apply.
